when you do that you can't really attack the player but just see casting animation.

I know what to do, you could attack the other player but he would not suffer damage only appear miss, however, is being made possible attack and kill player anywhere, even in the city that are not pvp, just holding SHIFT.

on latest hercules clean, the attack never start just casting then stop no miss or etc.
and was not able to attack player in city :)

I'm not being able to reproduce this issue, the attack animation doesn't even start when pvp is off what client are you using and are any configurations different from a clean Herc?

I just use hercules, and I'm using a version I downloaded to 2 weeks.

You should update your Hercules and use a revision without any modifications, and post here again how to reproduce this issue, until then I'm marking this as Unable to reproduce.
